If employer company and foreigner meets related criteria, the next thing is applying for work permit.
There are two work permit application options;
· Local application (in case foreigner keeps residence permit)
· Work Visa application from abroad (by applying Turkish Consulate)
Foreigners who have obtained a residence permit in Turkey for at least 6 months (application can be made at any time before the expiration date) can apply locally for work permit without leaving from Turkey.
For Work visa application, foreigner must apply to Turkish Consulate in his/her home country or country which he/she keeps residence permit. After foreigner applies to Turkish Consulate; Consulate issues a Visa reference number and employer company can start work permit application inside Turkey.
Provided that it does not exceed the duration of the employment contract, work permit is granted for a maximum of one year at the first application. If the work permit extension application is evaluated positively, the foreigner is granted a work permit for a maximum of two years in the first extension application and up to three years in the following extension applications, in case foreigner is employed by same employer.
REQUIRED DOCUMENTS FOR WORK PERMIT APPLICATION
FROM EMPLOYER COMPANY
1. SGK accrual and list showing all employees for the last month,
2. Trade registry gazette of Turkish employer company showing last address information, establishment and authorized personnel,
3. Commercial activity certificate of the company. It will be obtained from the related Chamber of Commerce,
4. Last year’s balance sheet and profit/loss table certified by tax office or sworn auditor, (Last year’s corporation tax declaration can be submitted after the approval of either tax office or sworn auditor.) This document can be arranged from company’s online tax office system (İnteraktif Vergi Dairesi),
5. Signature circular copy,
6. An invitation letter prepared for Turkish Consulate (in English or Turkish/ signed) (it should be printed to company letterhead)- for abroad Work visa applications only,
7. No tax debt letter from Tax Office,
8. Incase foreigner is assigned to Turkey by mother company, assignment letter which will be signed by mother company,
9. In order to complete work permit application, the authorized person who is keeping Social Security passwords of the employer company, must obtain Electronic Signature.
FROM EMPLOYEE
1. 1 biometric photograph with white background,
2. Notarized and Turkish translated passport,
3. Notarized and Turkish translated bachelor degree diploma,
4. Residence Permit Card Copy- for local work permit applications,
5. Name and surname information of wife or husband,
6. Telephone number, e-mail address and accommodation address information,
7. Employment Contract both signed by the employer company and the applicant (it should be prepared in the applicant’s native language and Turkish translated, if the applicant knows English it can be prepared both Turkish and English),
8. Visa application form and visa reference number issued by Turkish Consulate- for abroad Work visa applications only,
9. If Social Security premiums of foreign applicant will be paid in abroad (for cases which Turkey has Social Security Agreements); foreigner’s Social Security Exemption certificate. It will be obtained from related Social Security Institution in home country.
For Household Employees – Babysitter, patient and elderly care personnel
1. 1 biometric photograph with white background,
2. Notarized and Turkish translated passport,
3. Residence Permit Card Copy- for local work permit applications,
4. Visa application form and visa reference number issued by Turkish Consulate- for abroad Work visa applications only,
5. Employer’s electronic signature,
6. Employer’s certificate of identity register copy,
7. Employer’s address registration document,
8. For elderly and patient care; identity card of the person to be cared, residence document and health report signed by doctor,
9. For babysitter, birth certificate of children to be cared.
*Depending on the application type, company’s, employee’s status and Consulate application, there may be change on requested documents and procedures.
